Terms of Service

1. Acceptance of Terms

Tiny Owl (“the Service”) is operated by Bird Dog Digital, LLC (“Tiny Owl”, “we”, “us”, or “our”). By accessing or using the Service, you agree to be bound by these Terms of Service, which form a binding agreement between you and Bird Dog Digital, LLC. If you do not agree to these terms, do not use the Service.

2. Description of Service

Tiny Owl provides a push notification platform that allows teams to send notifications to team members’ mobile devices via API webhooks. The Service includes web-based dashboard access and API endpoints for notification delivery.

3. Definition of “Ping”

“Ping” means a single notification event initiated by a User or an authorized integration, such as a webhook request, API call, or in-app trigger, regardless of the number of recipients, devices, or endpoints to which that event is delivered.

For clarity, a Ping does not refer to individual notification deliveries, device-level messages, retries, or fan-out operations performed by the Service to distribute an event to multiple recipients.

• Example: If a webhook triggers a Ping that notifies 25 team members across multiple devices, this counts as one (1) Ping, not 25.

4. Billing and Usage

Usage limits are calculated based on the number of Pings generated during a billing period. Each qualifying event counts as one (1) Ping, irrespective of team size, number of members, or number of connected devices.

• Free Tier: The free tier provides 100 Pings per month at no cost, with no time limit and no payment method required. The allowance resets at the start of each billing period. Once the monthly allowance is exhausted, further Pings are declined until the allowance resets or you upgrade to a paid plan.

• Team Creation: Creating teams with multiple invited members is only available on paid plans. Free tier accounts are limited to a single user.

• AI Rewrite Allowance: Each plan includes a monthly allowance of AI rewrite processing attempts (Free: 10, Starter: 10,000, Pro: 25,000, Team: 50,000). An attempt counts when the Service submits a Ping for AI processing, including when the AI provider fails or returns an unusable response. Unused AI rewrites do not roll over.

After the monthly AI allowance is exhausted, Pings continue to be delivered using their original title and body. AI rewriting resumes when the allowance resets, unless a different allowance or overage arrangement is shown for your plan.

• Plan Limits: Current monthly allowances per plan:

• Free: 100 Pings, 10 AI rewrites, 1 member, up to 30 days of notification history.
• Starter: 10,000 Pings, 10,000 AI rewrites, up to 5 members, up to 90 days of notification history.
• Pro: 100,000 Pings, 25,000 AI rewrites, up to 20 members, up to 1 year of notification history.
• Team: 1,000,000 Pings, 50,000 AI rewrites, up to 100 members, up to 1 year of notification history.

• Notification History: Notifications older than your plan’s retention window may be deleted. If your plan changes, the new plan’s window applies to existing history, so a downgrade may shorten how long past notifications are kept. See the Privacy Policy for details.

These allowances are also shown on your dashboard and on the plan selection screen. We may adjust plan limits with notice as described in Section 14.

5. Fair Use and Safety Valve

The Service reserves the right to enforce reasonable rate limits, batching, queuing, or temporary restrictions on Ping processing in order to maintain system stability, prevent abuse, or ensure fair use across customers.

Excessive or abnormal usage patterns that materially impact system performance may require plan upgrades or custom arrangements.

Failed delivery attempts, retries, or internal processing steps initiated by the Service do not count as additional Pings unless a new qualifying event is generated by the User or an integration.

6. Device Limits

Each account may register up to 10 active devices. Registering an additional device may replace the least recently used device registration.

7. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. You are responsible for all activities that occur under your account.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Send spam, unsolicited notifications, or harassing content
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Reverse engineer or attempt to extract source code
• Resell or redistribute the Service without authorization

9. Payment and Refunds

Paid subscriptions are billed in advance on a monthly or annual basis. All payments are non-refundable. There are no refunds or credits for partial months of service, downgrade refunds, or unused notifications. You may cancel your subscription at any time, and you will continue to have access until the end of your billing period.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation.

11. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Tiny Owl and is protected by copyright, trademark, and other intellectual property laws.

12. Limitation of Liability

To the maximum extent permitted by law, Tiny Owl shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

13. Termination

We may terminate or suspend your account at any time for any reason, including violation of these terms. Upon termination, your right to use the Service will immediately cease.

14. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes. Your continued use of the Service after changes constitutes acceptance of the new terms.

15. Notification Encryption (Optional Feature)

Tiny Owl offers optional notification encryption as an add-on feature available on eligible plans. This feature is modular and off by default: it must be explicitly enabled for each team, individually, and applies only to teams for which it has been turned on.

When enabled, the body and data payload of a notification are encrypted before delivery through Apple’s, Google’s, and Expo’s push infrastructure and are decrypted on your team members’ devices. This limits exposure of notification contents to those third-party push intermediaries and on the device lock screen.

This is not zero-knowledge end-to-end encryption. To provide AI rewriting, delivery, and related functionality, Tiny Owl processes notification content in unencrypted form on its servers at the time it is submitted, and the encryption keys are managed by Tiny Owl. Tiny Owl can therefore technically access notification content, and you should not rely on this feature as a guarantee that Tiny Owl is unable to read your notifications. Notification titles may not be encrypted in all cases and, like all notification content, remain accessible to Tiny Owl. You are responsible for determining whether this feature is suitable for any regulatory or contractual requirements that apply to your data.

16. Public Channels

A public channel is an open feed that anyone can subscribe to from the Tiny Owl app without creating an account. Creating one requires a paid plan. Each plan includes a fixed number of channel slots: one on Starter, two on Pro, and four on Team. A draft occupies a slot, so an unpublished channel still counts against your limit.

New channels start as drafts, visible only to you and to anyone you give the direct link to. Appearing in the app's browse directory requires review. We may decline to list a channel, unlist it, or suspend delivery at any time, and we will do so for channels that are unlawful, deceptive, or that present a best-effort feed as an official alert.

If your channel carries seismic, weather, health, safety or similar information that someone might act on, you must identify the source and provide a disclaimer, both of which are shown at the moment a person subscribes. You are responsible for everything you send to your subscribers.

Pings sent to channel subscribers count against your monthly notification allowance exactly like any other notification. A push cannot be recalled once it has been sent.

Subscribing to a public channel never requires an account. Subscriptions belong to the device rather than to a person, and a subscriber can leave a channel at any time from within the app.
